Pension Entitlements

The law recognises that within a marriage spouses agree that one will be the main provider and the other will, for example, raise the family. As a result, one spouse often has a larger pension entitlement than the other.
 

It is possible to equalise this position and the Court is able to order a division of pension, for example part of the pension to be transferred into a new pension fund for the other spouse. This is something that can only be achieved with the assistance of the Court and cannot therefore be obtained within an informal separation.
