We all know that every marriage is different & the law recognises that too. It is not the case that every marriage is treated the same as different factors will be relevant in each case. The law considers the following:- 

     1. The Welfare of the Children
     2. Available capital, Income & Other Resources
     3. Financial Needs
     4. Age of Parties & Length of Marriage
     5. Standard of living enjoyed before the breakdown
     6. Any physical or mental incapacity
     7. Contributions
     8. Bad behaviour


The starting point is to try and reach agreement with your spouse. This will involve a process of Disclosure, where up to date documents in relation to all assets will be exchanged with your spouse. The aim is to ensure that any discussions are had in an open and honest manner.


In many cases, mediation may be suitable to help you reach agreement with your Spouse. Alternatively, you may wish to work Collaboratively with your spouse. We are able to assist you with both of these options.


In the event that it is not possible to reach an agreement with your spouse, then an Application to Court may be required. Ultimately here, the District Judge will make a decision as to your financial arrangements. Court Proceedings can be lengthy and can be significantly more expensive than reaching agreement outside of Court Proceedings.
