Divorce
In order to divorce you have to have reached the decision that the marriage has ‘irretrievably broken down’. If this is not the case then we can help you consider other options. You must then decide upon one of 5 reasons as to why the marriage has broken down:-
1. The other party’s Adultery
2. The other party’s Unreasonable Behaviour
3. 2 years Separation with Consent
4. 5 years Separation
5. Desertion for 2 years
A Petition for divorce is then presented to the Court & the District Judge will consider whether you are entitled to a Divorce. The whole process takes around 6 months and will usually not involve you attending Court.
We would always advise you to resolve all issues relating to finances and children at the time of your divorce, the divorce process itself does not address these issues.
